Request Council Agendize Discussion of NOI for International Boundary and Water Commission Litigation

Honorable Mayor & Council,

The last time I addressed the IBWC litigation with each of you was at the September 19th City Council meeting where I thanked you during oral communications for the “Reimbursement Agreement” — up to $50K in legal fees reimbursed to IB based on litigation milestones, etc. It’s very important to note at that moment no other South Bay City had committed to join IB in signing the Notice of Intent (NOI) to file suit against the IBWC and Veolia Water. After I thanked you, at the same council meeting, the Port announced they were joining with IB to sign the NOI. Subsequently, every other South Bay City and the County has signed the NOI to join forces with Imperial Beach — Chula Vista, San Diego, National City, the County and Port have all joined IB to sign the NOI. The City of Coronado is now the only South Bay City that has not signed the NOI. As a taxpaying resident of Coronado, founder and administrator of Coronado Residents Against Poop (CRAP), and attorney with Citizens Against Sewage (CAS), it is unacceptable that Coronado is the lone South Bay City withholding their support in signing the NOI.

Coronado is the city most affected by trans-border sewage after IB. IB is asking for our support, and Imperial Beach does not want it in the form of Coronado’s Reimbursement Agreement. Our neighboring cities have asked us to join them in signing the NOI, because this is the action required to show a United Front. This is about Solidarity in the South Bay. Right now, Coronado is the odd man out… and I don’t believe Coronado residents’ voices are being heard.

[Attached to original letter was an agenda item request form asking council to agendize a discussion of the NOI at the next City Council meeting.] If you need to do this in closed session because it is a litigation matter, then so be it, but residents would prefer transparency and for this topic to be addressed openly and publicly in regular session.
